Florida Diamond Recruiting Services (“FDRS”) is operated by P&M Sports Consulting LLC. By accessing or using the FDRS website, platform, player portal, services, forms, subscriptions, communications, or related features, you agree to be bound by these Terms of Service and Privacy Policy (“Terms”).

If you do not agree to these Terms, you may not use our website, portal, communications, or services.

1. Services Provided

P&M Sports Consulting LLC provides recruiting services under the Florida Diamond Recruiting Services and FDRS brands. Services may include, but are not limited to:

• Player profile creation, hosting, and promotion.
• Recruiting consultation, evaluations, and strategy support.
• Access to player portals, performance analytics, and recruiting tools.
• College coach and recruiter contact strategy.
• Showcase, event, camp, or recruiting opportunity information.
• Subscription-based recruiting, profile, or membership services.
• Email, phone, portal, and SMS/text communications related to services.

Packages, pricing, deliverables, subscription terms, and service features are described on our website or in related order forms and may be updated from time to time.

2. Eligibility

You must be at least 13 years old to create an account or use FDRS services. If you are under 18, a parent or legal guardian must consent to your participation and use of the services.

Parents, guardians, athletes, coaches, and other users agree that all information submitted to FDRS is accurate, lawful, and authorized to be shared.

3. Account Registration

You agree to provide accurate, complete, and updated information when registering, purchasing, or submitting information through FDRS. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

FDRS may suspend or terminate access if information is false, misleading, unauthorized, abusive, or violates these Terms.

4. Payment and Subscriptions

Some services require payment. By purchasing a package, subscription, profile service, consulting service, or other FDRS service, you agree to pay all applicable fees.

• All fees are due according to the checkout page, invoice, agreement, or order terms.
• All payments are non-refundable unless otherwise stated in writing.
• Subscription services may auto-renew unless canceled before the renewal date.
• FDRS may modify package pricing or services prospectively.

5. User Content

You may upload, submit, or provide player information, statistics, videos, images, social media links, academic information, coach references, schedules, and other recruiting materials.

You grant P&M Sports Consulting LLC a non-exclusive, royalty-free, worldwide license to host, display, share, promote, reproduce, and distribute submitted content for recruiting, marketing, profile, player promotion, and service-related purposes.

You are solely responsible for ensuring you have the right to upload, publish, or share any submitted content, including photos, videos, music, logos, likenesses, statistics, academic information, and third-party materials.

6. Prohibited Conduct

You agree not to:

• Post or submit false, misleading, defamatory, offensive, or unlawful content.
• Harass, threaten, impersonate, or abuse other users, athletes, coaches, or staff.
• Attempt to breach, disrupt, scrape, reverse engineer, or misuse the website or portal.
• Use FDRS for purposes unrelated to athletic recruiting or legitimate service use.
• Upload content that infringes intellectual property, privacy, publicity, or other rights.
• Use FDRS communications, including SMS, for spam, harassment, fraud, or illegal activity.

7. SMS / Text Messaging Terms

By providing your mobile phone number to FDRS, submitting a form, creating an account, purchasing a package, requesting information, opting in to receive messages, or otherwise consenting, you agree that P&M Sports Consulting LLC and Florida Diamond Recruiting Services may send text messages to the mobile number you provided.

Message Frequency

Message frequency varies based on your account activity, service package, requests, subscriptions, and communication preferences. FDRS does not guarantee a specific number of messages per week or month.

Message and Data Rates

Message and data rates may apply. Your mobile carrier may charge fees for SMS messages, data usage, or related mobile services. FDRS is not responsible for carrier charges, delayed messages, failed delivery, or mobile network issues.

Consent Is Not Required to Purchase

Consent to receive marketing text messages is not a condition of purchasing any goods, services, subscriptions, or packages from FDRS.

Opt-Out Instructions

You may opt out of SMS messages at any time by replying STOP to any FDRS text message. You may also contact us directly at info@fldrs.net to request removal from SMS messaging.

After opting out, you may receive a one-time confirmation text confirming that you have been unsubscribed. After that, you should no longer receive SMS messages from that messaging program unless you opt in again or otherwise provide consent.

Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. SMS delivery depends on your mobile carrier, device, signal, and other factors outside of FDRS control.

Mobile Number Ownership

You represent that you are the account holder or authorized user of the mobile number you provide. If your mobile number changes or you are no longer authorized to use that number, you agree to notify FDRS promptly.

SMS Privacy

Mobile opt-in data and consent records will not be sold. FDRS does not sell or share SMS opt-in consent, mobile numbers, or SMS messaging data with third parties for their own unrelated marketing purposes. SMS-related data may be shared with service providers only as needed to operate, deliver, secure, support, or manage the SMS program.

8. Privacy Policy

FDRS may collect personal information including name, email address, phone number, mobile number, athlete information, parent or guardian information, coach contact details, recruiting information, academic information, payment information, website usage data, portal data, and communications.

How We Use Information

• To provide and manage recruiting services.
• To create, host, and promote player profiles.
• To communicate with athletes, parents, guardians, coaches, and customers.
• To process payments, subscriptions, and service requests.
• To send email, phone, portal, and SMS communications.
• To improve website, portal, marketing, and recruiting services.
• To comply with legal, tax, accounting, and regulatory obligations.
• To prevent fraud, abuse, unauthorized access, and security issues.

How Information Is Shared

FDRS may share information with service providers, technology vendors, payment processors, website hosts, analytics providers, communication platforms, SMS providers, email platforms, recruiting partners, coaches, schools, and other parties as needed to provide services, operate the platform, or promote athletes for recruiting purposes.

Player recruiting information may be shared with college coaches, recruiters, athletic programs, scouts, or other recruiting-related contacts as part of the services.

9. NCAA and Regulatory Compliance

You are responsible for ensuring that your use of FDRS services complies with NCAA, NAIA, NJCAA, state high school association rules, school rules, team rules, conference rules, and other applicable governing body requirements.

P&M Sports Consulting LLC is not responsible for eligibility impacts, recruiting outcomes, scholarship decisions, coach decisions, school decisions, or governing body interpretations arising from your use of FDRS services.

10. Termination

FDRS may suspend, restrict, or terminate your account, profile, access, subscription, or services at its discretion for violations of these Terms, non-payment, misuse, suspected fraud, unlawful activity, abusive conduct, or conduct that may harm FDRS, users, athletes, coaches, or partners.

11. Limitation of Liability

P&M Sports Consulting LLC is not responsible for any outcomes of the recruiting process, including but not limited to college placement, scholarship offers, roster spots, admissions decisions, coach responses, exposure results, draft outcomes, or athletic opportunities.

FDRS does not guarantee recruitment results, offers, scholarships, commitments, playing time, admissions outcomes, or professional opportunities.

12. Disclaimers

FDRS services are provided on an “as available” and “as is” basis. We do not guarantee that the website, portal, SMS program, communications, or services will be uninterrupted, error-free, secure, or available at all times.

Recruiting information, coach contact information, school information, deadlines, and rules may change. Users are responsible for independently verifying any information before relying on it.

13. Changes to Terms

We may update these Terms at any time by posting revised terms on our website. Continued use of the website, portal, communications, SMS program, or services after changes are posted indicates acceptance of the updated Terms.
